Section 1. It shall be unlawful for any person, firm, assoo-
ia-tion, or corporation to drive any commercial motor vehicle
or truck-tractor having a gross weight in excess of three
thousand pounds, with or without load, upon, over or across
any of the following streets or avenues to-wits
On Avenue r4 from 11th to 15th Streets
On 15th Street from Avenue q to 0
On Avenue 0 from 11th to 19th Streets
On 19th Street from Avenues 0 to L
On 11th Street from Avenues 0 to L
On Avenue L from. 8th to 10th Streets
On 8th Street from Avenues K to L
On Avenue F from 9th to llth Streets
On 10th Street from Avenues I to K
It being intended hereby to prohibit the driving on any of
the above named streets and avenues of any motor vehicle other
than private passenger care and/or light pick-up delivery
trucks.
Section 2,, The term motor vehicle as used herein shall include
every self propelled devise in, or by which any person or prop-
erty is or may be transported or drawn upon the above described
streets and avenues.
11he term, truck-tractor as used herein shdll! mean every
motor vehicle designed or used primarily for drawing other
vehicles and not. so constructed as to carry a load other than as
a part of the weight of the vehicle and load so drawn*
The term commercial motor vehicle as used herein means
any motor vehicle, other than a motorcycle,designed or used
for the purpose of transporting persons and/or property and
shall include motor-bussesr

The term private passenger car as used herein shall mean
any motor vehicle.oth,er than a motorcycledesigried or used
primarily for the purpose of transporting persons for the con-
verience, comfort and pleasure of the owner thereof and not
for hire.
The term light-pick-up delivery truck as used herein shall
any
mearAinbtor vehicle designed for and used primarily by local
drug stores, grocery stores, and dry goods stores and other
local businesses for the delivery to residents of the city of
Huntsville of merchandise purchased by said citizens from said
respective drug stores, grocery stores, dry goods stores, and/
or other business houses operating within the city of Huntsville,
Texas
Seation 3. Any person, (firm, association, or corporation
violating any of the provisions of this ordinance shall be
dd6mled guilty of a misdemeanor and upon, conviction therefor
shall be fined in any sum not less than one dollar ($1.00) nor
more than two hundred dollars ($20000)4,
Seation 40 The fact that the above named streets and avenues
have been and are now being paved and improved with materials
not of sufficient strength to withstand heavy traffic and that
said above named streets and avenues are not state highways
and passage there over is not necessary or desirable for through
traffic and the fact that continuous use of said streets and
avenues for the purpose of passage by heavy traffic will destroy
and break-down paving on said streets and avenues, creates an
emergency and this ordinanwa shall take effect immediately after
its passage, approval and publication*

day of September 1935 referred to the committee on-streets and
bridges.
