TEXAS, BY ADDING A NEW SECTION TO BE ENTITLED CHAPTER , PRO-
HIBITING THE DRILLING FOR OIL OR GAS WITHIN CERTAIN AR TFIN THE
CITY LIMITS OF THE CITY OF HUNTSVILLE, TEXAS; PROVIDING THAT ANY
VIOLATION SHALL BE PUNISHABLE BY A FINE NOT EXCEEDING $200.00; PROVID-
ING FOR SEVERABILITY DECLARING AN EMERGENCY; AND PROVIDING THIS OR-
DINANCE SHALL BECOME EFFECTIVE IMMEDIATELY UPON ITS PASSAGE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE,
TEXAS, THAT:
Section 1. The .purpose of this Ordinance is to prohibit the
drilling of oil and gas wells in certain specified areas, being deemed
necessary because of the inherent risks and the unusual damages atten-
dant upon the extremely combustible nature of these products and in
their development, and to promote the health, safety and welfare of
the citizens of the City of Huntsville, Texas.
Section 2. It shall be unlawful for any person, corporation,
or any other legal entity to drill oil or gas wells on any lands with-
in the thickly settled portion of the City of Huntsville, Texas.
Section 3. It shall be unlawful for any person, corporation,
or any other legal entity to drill oil or gas wells on any lands sit-
uated within two hundred feet (200' ) of any dwelling for use by one
or more families within the city limits of the City of Huntsville,
Texas.
Section 4. It shall be unlawful for any person, corporation,
or any other legal entity to drill oil or gas wells upon lands dedicated
to public use within the city limits of the City of Huntsville, Texas.
Section 5. Any person violating the provisions of this ar-
ticle shall, upon conviction, be deemed guilty of a misdemeanor and
shall be punished as provided in Section 1-8 of the Code of Ordinances
of the City of Huntsville, Texas.
Section 6. If any section, subsection, sentence, clause or
phrase of this ordinance is, for any reason, held to be unconstitu-
tional, such decision shall not affect the validity of the remaining
portions of this ordinance. The City Council hereby declares that it
would have passed this ordinance, and each section, clause, or phrase
thereof, irrespective of the fact that any one or more sections, sen-
tences, clauses and phrases be declared unconstitutional.
