AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, ORDERING
A MUNICIPAL ELECTION TO BE HELD ON THE 4TH DAY OF APRIL, 1981, FOR THE PUR-
POSE OF ELECTING A MAYOR AT -LARGE AND FOUR COUNCILMEN FROM THE RESPECTIVE
WARDS ONE, TWO, THREE AND FOUR, AND FOR THE FURTHER PURPOSE OF VOTING ON THE
ADOPTION OF THE FIREMEN'S AND POLICEMEN'S CIVIL SERVICE ACT FOR THE POLICE
DEPARTMENT ONLY; PROVIDING FOR ELECTION OFFICERS; DESIGNATING THE PLACES AND
MANNER OF HOLDING SAID ELECTION; AND PROVIDING FOR THE POSTING AND PUBLICA-
TION OF NOTICE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS THAT:
Section 1: The regular municipal election of the City of Huntsville, prescribed
by Section 6.01 of the City Charter, shall be held between the hours
of seven (7:00) o'clock A.M. and seven (7:00) o'clock P.M. on the 4th
day of April, 1981, in said City for the purpose of electing a Mayor
and four councilmen for Wards 1 through 4, and for the further purpose
of voting on the Adoption of the Firemen's and Policemen's Civil
Service Act for the Police Department.
Section 2: The City is hereby divided into four (4) election precincts, said
precincts to have the same boundaries as the wards established under
Section 4.04 of the City Charter. The polling places and election
officials for these election precincts shall be as follows:

Section 3: This election shall be held in accordance with, and shall be governed
by, the Election Laws of the State of Texas. In all City elections,
the Mayor, City Secretary, or City Council shall do and perform each
act as in other elections required to be done and performed, respec-
tively, by the County Judge, the County Clerk, or the Commissioners'
Court.
Section 4: A Mayor shall be elected by a majority vote of the City at- large.
The Mayor shall be a bona fide resident of the City. The Mayor to
be elected shall hold office for a period of two years.
Section 5: One Councilman shall be elected from each of the respective ward
numbers One (1), Two (2), Three (3), and Four (4) of the City by a
majority vote of each respective ward. Each Councilman so elected
shall be a bona fide-resident of the district represented by him.
The Councilman to be elected shall hold office for a period of two
years.
Section 6: The Mayor and each of the four Councilmen shall be citizens of the
United States, qualified voters of the State of Texas, residents within
the present corporate limits of Huntsville for at least six months,
and current in payment of taxes and assessments due to the City.
Section 7: Any eligible and qualified person may have his name upon the official
ballot as an independent candidate for the office of Councilman, for
the office of Mayor, or for the office of Councilman from his respec-
tive ward, by filing his sworn application with the Mayor of the City
on or before thirty (30) days prior to the date of the election. The
application shall be substantially as follows:
To the Mayor of the City of Huntsville, Texas:
I hereby request that my name be placed upon the official ballot
for the election to be held on the 4th day of April, 1981, as a
candidate for of said City. I hereby certify that I am
a citizen of the United States of America and that I am eligible
to hold office under the Constitution of this state and have resided
in this state for a period of twelve months next preceding the date
of said election and have resided in this City in which I offer myself
as a candidate for months next preceding the date of said
election.

Section 8: All candidates shall file with said application, the loyalty affidavit
required by Article 6.02 of the Election Code in substantially the
following form:

swear that, if elected, I will support and defend the Constitution
and laws of the United States and of the State of Texas.

Section 9: The order in which the names of the candidates are to be printed on
the ballot shall be determined by a drawing of the City Secretary as
provided by Article 6.05 C § 3 of the Election Code.
The form of the ballot for said election shall be as follows:

Section 10: City Secretary, Ruth DeShaw, is hereby appointed as the Clerk of
Absentee Voting, and the

is hereby designated as the place for absentee voting for the election.
During the lawful absentee voting period, such clerk shall keep such
place for absentee voting open for absentee voting from 8:00 A.M. to
12:00 Noon and from 1:00 P.M. to 5:00 P.M. on each day except Saturdays,
Sundays, and official state holidays.
Section 11: The Chief of Police is hereby directed to post a properly executed
copy of the Election Order and Notice at each polling place within
the City at least twenty (20) days before the date of said election.
The Mayor is directed to give notice of said election by publishing
a copy of the Election Order and Notice in a newspaper of general
circulation with said City not more than twenty-five (25) nor less
than ten (10) days before the date of said election.
Section 12: This notice shall take effect from and after its passage.
