ORD 2012-35 - Amending Ch 44 Traffic
ORDINANCE NO. 2012-35 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, AMENDING CHAPTER 44, TRAFFIC AND MOTOR VEHICLES, OF ITS CODE OF ORDINANCES BY PLACING STOP SIGNS ON ROBINSON CREEK PARKWAY AT MEMORIAL HOSPITAL DRIVE; AND MAKING OTHER FINDINGS AND PROVISIONS RELATED THERETO; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, THAT: Section 1: The following intersection with traffic control measure consisting of 3-way Stop shall be ratified by the amendments shown below: Intersection On At Robinson Creek Parkway Memorial Hospital Drive Section 2: The City Manager is authorized and directed to cause the placement of proper signs along the above described streets. Section 3: It shall be unlawful for driver of a vehicle to disobey the instruction of the signs placed in accordance with the provisions of this ordinance unless at the time otherwise directed by a Police Officer. Section 4: Any person, firm or corporation violating any provision of this ordinance or failing to comply with any requirement of the ordinance will be guilty of a misdemeanor as provided by Article I, Section 44-4 of Chapter 44 of the Huntsville Code of Ordinances being punishable by a fine of not less than $1.00 nor more than two hundred ($200.00) dollars; except that minors who have passed their 14th birthday but have not reached their 17th birthday shall be punished by a fine of not more than$100.00. Section 5: If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect any of the remaining provisions of this ordinance. Section 6: All ordinances and parts of ordinances in conflict with the provisions of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 7: This ordinance shall take effect ten (10) days after its passage by the City Council.
