ORD CC 11/26/47 - Tax ValuationTIE STATE OF TEXAS 0 COUNTY OF WALKER 0 CITY OF HUNTSVILLE 0 BE IT REMEMBERED that on the 4th day of November, 1947, the City Council of the City of Huntsville, Texas convened in regular scssion Et its meeting place at the City Hell and Fire Station in said city, all of the members of the council being present, and having attended to the routine business coming on for consideration recessed; that said council regularly recon- vened rt an adjourned session on Novemb r 26, 1947 at the City Hall and Fire Station in said city, riith the following members pres- ent, namely: Wilbourn S. Gibbs, Mayor, J. 0. Thompson, J. N. Scar- borough, W. T. Robinson, ' ilbur Smither and Sam Robbins Aldermen, being present, when, among other proceedings had, the following ordinance was passed: "AN ORDINANCE AMENDING SECTION 11 OF AY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, DATED NOVEMBER 4, 1947, ORDERING THE ISSUANCE OF $90,000.00 OF AIRPORT BONDS OF SAID CITY, TO PROVIDE FOR THE LEVY, AS- SESSMENT AND COLLECTION OF A TAX OF TWENTY FIVE (250) CENTS ON THE ONE HUNDRED DOLLARS VALUATION OF ALL TAXABLE PROPERTY WITHIN THE LIMITS OF SAID CITY TO PAY THE INTER- ST AND CREATE A SINKING FUND FOR THE REDEMPTION THEREOF; APPROPRIATING MONEY OUT OF THE AVAILABLE REVENUES ON HAND TO PAY THE INTEREST ON SAID BONDS DUE ON JUNE 1, 1948 AND ON DECEMBER 1, 1948; AND DECLARING AN EMERGENCY." Alderman Robinson moved the ordinance be placed on its first reading, seconded by Alderman Scarborough, and carried by the following vote: AYE: Robinson, Scarborough, Thompson, Smither and Rob- bins NO: None. Carried; ordinance passed on first reading. Alderman Thompson moved that the rules be suspended and that the ordinance be placed on second reaGing; seconded by Alderman Robinson, and carried by the following vote: AYE: Robinson, Scarborough, Thompson, Smither and Rob- bins NO: None. Ca:rried, ordinance placed on second reading. Alderman Scarborough moved that the ordinance pass second reading; seconded by Aldermen Thompson, and carried by the following vote: AYE: Robinson, Scarborough, Thompson, Smither and Rob- NO: None. Carried; ordinance parsed second reading. Alderman Robinson moved that the ordinance pass third and final reading; seconded by Alderman Thompson, and carried by the following vote: AYE: Robinson, Scarborough, Thompson, Smither and Rob- bris NO None. 7ayor Gibbs then declared the ordinance finally passed. The ordinance follows: THE STATE OF TEXAS COUNTY OF WALKER CITY OF HUNTSVILLE I, Kete Barr Ross, City Secretary of the City of Hunts- ville, Texas, do hereby certify: 1. That the Ordinance dated July 1, 1947, shown on pages 3 to 6 of the Transcript Re: $50,000.00 City of Huntsville Street Improvement Bonds of 1947 and City of Huntsville $90,000.00 Airport Bonds of 1947, and of record in Volume H, page 490, of the Minutes of the City Council of the City of Huntsville, Texas, calling an election to be held on July 29, 1947 within said city, to determine whether the bonds of said city, denominated as "Airport Bonds ", "Street Improvement Bonds" and "Courthouse Yard Bonds" should be issued by the city, was introduced by Alderman J. N. Scarborough, who moved that the same be passed and was seconded by Alderman T. Robinson, as shown by the original ordinance and by its record. 2. That the Ordinance dated august 5, 1947, shown on pages 13 to 17 of the above transcript, and of record in Volume H, page 495, of the Minutes of the City Council of the City of Huntsville, Texas, was introduced by Alderman W. T. Robinson, who moved that the same be passed, and was seconded by Alderman J. N. Scarborough, as shown from the original ordinance and the record thereof. This Ordinance was passed at a regular session of the City Council of the City of Hunts- ville, Texas, at its regular meeting place in the City hall and Fire Station, in said city, on August 5, 1947, the following members being present, to -wit: Honorable Wilbourn S. Gibbs, Layer, W. T. Robinson, Sam Robbins, J. N. Scarborough, Victor Randel and J. 0. Thompson, Aldermen, and Kate Barr Ross, City Secretary. 3. That the moneys appropriated out of the revenues of said city under Section 11 of the Ordinance, shown on pages 18 to 23 of the above transcript, and the amendment thereof by Ordinance of date November 26, 1947, shown in the Supplement and Addition to said Tran- script, were legally available, and the appropriation has, in fact, been actually made. That the moneys appropriated out of the revenues of said city under Section 11 of the Ordinance, shown on pages 24 to 29 of the above transcript, and the Amendment thereof by Ordinance of date November 26, 1947, shown in the Supplement end Addition to said Transcript, were legally available, and the appropriation has, in fact, been actually made. 4. That by Ordinance dated !pril 1, 1941, the City of Hunts- ville issued 50,000.00 of ` °aterworks Revenue Refunding Bonds, Series 1941, all dated April. 1, 1941 and bearing interest at two and one -half (22) per cent per annum, each and all of said bonds being due and pay- able serially on December 30, each and all of said bonds being in de- nominations of X1,000.00. fonds 46 to 50 were not issued and were cancelled. Bonds Nos. 31 to 35 due December 30, 1947, Bonds Nos. 36 to 40 due December 30, 1948, and Bonds Nos. 41 to 45 due December 30, 1949 are the only bonds of this series outstanding. These bonds are, in fact, tax 0 bonds, but ere actually paid from the revenues of the waterworks system. The statement in the Certificate of the Treasurer of the - 1 - City of Huntsville, Texas on page 32 of the above transcript, is erroneous in stating that these bonds are not tax bonds. The actual outstanding tax bond indebtedness of the City being 8129,500.00 as of November 1, 1947. Otherwise the statement of the Treasurer is correct. 5. As shown on page 1 of the above transcript, the City of Huntsville, Texas, by Ordinance dated December 4, 1888, adopted the general laws of the State of Texas. The form of the government of the city hes not been changed since that date. The city has no special charter. As a matter of convenience in the operation of the affairs of the city it has been customary for many years for the mayor to appoint standing committees such as: "Streets and Bridges ", "Airport ", "Ordinances ", etc. There is no authority in any of the ordinances of the city requiring or directing the appointment and naming of such committees. There is no ordinance in the city re- quiring ordinances to be submitted to any of the committees, nor is there anycrdinance providing thet ordinances not submitted to such committees shall be voidable or that their validity shall be questioned by reason of such failure. As a matter of practice, some ordinances are submitted to committees and some are not, but there is no law of the city requiring that such procedure be followed. This certificate shall be tr'ated as asupplement to the transcript Pe: $50,000.00 City of Huntsville Street Improvement Bonds of 1947, and City of Huntsville 890,000.00 Airport Bonds of 1947, heretofore filed with the Attorney General of the State of Texas.
