ORD CC 11/10/47 - Airport Bond ElectionTHE STATE OF TEXAS COUNTY OF WALKER CITY OF HUNTSVILLE I, Kate Barr Ross, City Secretary of the City of Hunts- ville, Texas, do hereby certify that the above and foregoing copies of: (1) An Ordinance dated July 1, 1947 calling an election to be held on July 29, 1947, within said City, to determine whether the bonds of said City, denominated as "Airport Bonds ", "Street Improvement Bonds" and "Courthouse Yard Bonds ", should be issued by said City, which Ordinance is of record in Volume H, page 490, of the Minutes of said City Council; (2) Election Notice dated July 2, 1947, issued pursuant to said Bond Election Ordinance; (3) Printer's and Marshal's Returns of said Election Notice and accompanying clipping from The Huntsville Item; (4) Election Returns of seid election dated July 29, 1947, which are of record in Volume H, page 509, of the Minutes of said City Council; (5) An Ordinance dated August 5, 1947 canvassing the return and declaring the results of said bond election, which Ordinance is of record in Volume H, page 4951 of the Minutes of said City Coun- cil; (6) An Ordinance dated November 4, 1947 ordering the issuance of Ninety Thousand ($90,000.00) Dollars of bonds of said City, denom- inated as "Airport Bonds of 1947", which Ordincnce is of record in Volume H, page 504, of the Minutes of said City Council; (7) An Ordinance dated November 4, 1947 ordering the issuance of Fifty Thousand ($50,000.00) Dollars of bonds of seid City, denomi- nated as "Street Improvement Bonds of 1947 ", which Ordinance is of record in Volume H, page 507, of the Minutes of said City Council, - are true and correct copies of the originals thereof now on file in my office, and are recorded in the Minutes of said City Council of said City of Huntsville, Texas, as indicated above. I further certify that each and all of said Ordinances were passed at regular meetings of the City Council of the City of Huntsville, Texas, at each of which the Mayor and more than two - thirds (2/3) of all of the Aldermen were present, that each of said Ordinances were duly approved and signed by the Mayor in open Council, and that the Minutes of each of said meetings have been duly signed and approved by the Mayor. (SEAL) CITY SECRETARY CITY OF HUNTSVILLE, TEXAS "AN ORDINANCE AMENDING SECTION 11 OF AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, DATED NOVEMBER 4, 1947, ORDERING THE ISSUANCE OF $90,000.00 OF AIRPORT BONDS OF SAID CITY, TO PROVIDE FOR THE LEVY, AS- SESSMENT AND COLLECTION OF A TAX OF TWENTY FIVE (250) CENTS ON THE ONE HUNDRED DOLLARS VALUATION OF ALL TAXABLE PROPERTY WITHIN THE LIMITS OF SAID CITY TO PAY THE INTER- EST AND CREATE A SINKING FUND FOR THE REDEMPTION THEREOF; APPROPRIATING MONEY OUT OF THE AVAILABLE REVENUES ON HAND TO PAY TEE INTEREST ON SAID BONDS DUE ON JUNE 1, 1948 AND ON DECEMBER 1, 1948; AND DECLARING AN EMERGENCY." Section 1: That Section 11. of an ordinance of the City Council of the City of Huntsville, Texas dated. November 4, 1947, ordering the issuence of Ninety Thousand ($90,000.00) Dollars of airport bonds of seid city be and the some is hereby amended so as to read as follows: "Section 11: It is further ordained by the City Council of the City of Huntsville, Texas, that while said bonds, or any of them, are outstanding, and unpaid, there shell be annuelly levied, assessed and collected, in due time, form End manner, a tax upon all of the taxable property of said City of Huntsville, sufficient to pay the current interest thereon and to create a sinking fund of at leEst two (2%) per cent and sufficient to pay each installment of the principal es the same becomes due, in accordance with the mandates of the Laws and Constitution of the State of Texas. To pay the interest on said bonds for the first year and to create a sinking fund with which to pay the principal as the same becomes due, in accord- ance with the Laws and Constitution, there is hereby levied a tax of twenty five (250) cents on each One Hundred Dol- lars valuation of taxable property in said city for the year 1948, and the same shall be tssessed end collected and applied to the purpose named; and while seid bonds, or any of them, ere outstanding and unpaid, a tax for each yeer at a rate from yeer to year, as will be ample and suf- ficient to provide funds to pay the current interest on said bonds and to provide the necess-ry sinking fund, full allow- ance being made for delinquencies and costs of collection, shell be, and is hereby levied for each year, respectively, while srid bonds, or any of them, are outstanding and un- paid, and seid tax shell each year be essessed end col- lected end applied to the payment of the interest on and principal of said bonds. Out of the revenues of the City of Huntsville now on hand there is hereby appropriated the sum of One Thousand Two Hundred ($1,200.00) Dollars, which seid sum shall. be and is hereby ordered to be set aside for the purpose of pay- ing the interest on said bonds due on June 1, 1948, end a like amount is hereby appropriated out of the revenues of the city now on hand, which sum shall. -be and is hereby ordered to be set aside for the purpose of paying the in- terest on scid bonds due on December 1, 1948." Section 2: The fact that the Attorney General of the State of Texas, before approving the bond record and bonds, has required that Section. 11 of said ordinance be amended so es to provide for e specific tex levy for the year 1948, creates an emergency end an imperative public necessity that the rule requiring ordinances to be rend on three seperete days before final passage be suspended, and such rule is hereby suspended, and it is ordained that this ordinance shell take effect end be in full force immediately after its passage and approval. The above and foregoing ordinance, upon motion duly made and seconded, was adopted by the unrnimous vote of said council, and is approved by the Mayor, in open council, this the 26th day of November, 1947. /s/ Wilbourn S.
