ORD CC 08/05/47 Election noticeTHE STATE OF TEXAS 0 COUNTY OF WALKER 0 CITY OF HUNTSVILLE 0 WHEREAS, the City Council of the City of Huntsville, Texas, did on July 1, 1947 order an election to be held within and for the City of Huntsville, Texas on the 29th day of July, 1947 for the purpose of submitting to the qualified electors of said City who own taxable property in said City and who have duly rendered the same for taxation the following propositions, to -wit: FIRST PROPOSITION: Shall the City Council of the City of Huntsville, Texas, be authorized to issue the bonds of the City of Huntsville, Texas, in the principal sum of Ninety Thou- sand ($90,000.00) Dollars, payable and maturing serially within a given number of years beginning not more than five (5) years after the date thereof, and extending over a period of not to ex- ceed forty (40) years from and after the date thereof, within the discretion of the City Council of said City, bearing interest at the rate of not exceeding three and one -half (3) per cent per an- num, payable annually or semi- annually, at the discretion of said Council, and to levy a tax sufficient to pay the interest on said bonds and to create a sinking fund sufficient to redeem them at maturity for the purpose of improving and equipping the Huntsville Municipal airport in accordance with and as authorized by Article 1269h of the Revised Civil Statutes of the State of Texas of 1925, and the amendments thereto, and in accordance with and as authorized by Title 28 of the Revised Civil Statutes of the State of Texas of 1925, and the amendments thereto, and in accordance with the C;on- stitution and Laws of the State of Texas. SECOND PROPOSITION: Shall the City Council of the City of Huntsville, Texas be authorized to issue the bonds of the City of Huntsville, Texas, in the principal sum of Fifty Thousnnd ($50,000.00) Dollars, payable and maturing serially within e given number of years beginning not more than five (5) years after the date thereof, and extending over a period of not to exceed forty (40) years from and after the date thereof, within the discretion of the City Council of said City, bearing interest at the rate of not exceeding three and one -half (32) per cent per annum, payable annually or semi - annually, in the discretion of said Council, and to levy a tax sufficient to pay the interest on said bonds and to create a sinking fund sufficient to redeem them at maturity for the purpose of making permanent improvements upon the streets of said City of Huntsville by resurfacing the same, or any part there- of, and paving the same, or any part thereof, with concrete, rock, gravel or asphalt, or in aid thereof, and to pay the City's pro- portionate part, or all, of the cost of such street improvements and repairs within the discretion of said Council to be made under the front foot rule or plan, or otherwise, in accordance with and as authorized by Title 28 of the Revised Civil Statutes of the State of Texas of 1925, and the amendments thereto, and in accordance with the Constitution and Laws of the State of Texas. THIRD PROPOSITION: Shall the City Council of the City of Huntsville, Texas, be authorized to issue the bonds of the City of Huntsville, Texas, in the principal sum of Fifteen Thousand - 1 - �3 ( 15,000.00) Dollars, payable and maturing serially within a given number of years beginning not more than five (5) years after the date thereof, and extending over a period of not exceeding forty (40) years from and after the date thereof, within the discretion of the City Council of said City, bearing interest at the rate of not exceeding three and one -half (32) per cent per annum, payable annually or semi - annually, in the discretion of said Council, and to levy a tax sufficient to pay the interest on said bonds and to create a sinking fund sufficient to redeem them at maturity for the purpose of cutting down and reducing the size of the courthouse yard in said City and of increasing the width of the streets ad- jacent thereto and of making permanent improvements upon the widened streets of said City of Huntsville by paving the same with concrete, rock, gravel or asphalt, or in aid thereof, and to pay the City's proportionate part, or all, of the cost of such street improvements within the discretion of said Council to be made under the front foot rule or plan, or otherwise, in accordance with and as author- ized by Title 28 of the Revised Civil Statutes of the State of Texas of 1925, and the amendments thereto, and in accordance with the Con- stitution and Laws of the State of Texas, and; WHEREAS, said election was held at the City Hall and Fire Station in said City of Huntsville, Texas on said Jury 2.9, 1947 in accordance with the provisions of Title 22 of the Revised Civil Sta- tutes of the State of Texas of 1925, and the amendments thereto, and the Constitution and Laws of the State of Texas, and only qualified electors who owned taxable property in said City and who had duly rendered the same for taxation were allowed to vote therein, and all voters who favored the FIRST PROPOSITION had printed or written on their ballots the words, "FOR THE ISSUANCE OF THE AIRPORT BONDS AND THE LEVY OF THE TAX ", and those opposing said FIRST PROPOSITION had written or printed on their ballots the words, "AGAINST THE ISSU- ANCE OF THE AIRPORT BONDS AND THE LEVY OF THE TAX ", and all voters who favored the SECOND PROPOSITION had printed or written on their ballots the words, "FOR THE ISSUANCE OF THE STREET IMPROVEMENT BONDS AND THE LEVY OF THE TAX ", and all those opposing said SECOND PROPO- SITION had written or printed on their ballots the words, "AGAINST THE ISSUANCE OF THE STREET IMPROVEMENT BONDS PND THE LEVY OF THE TAX ", and all voters who favored the THIRD PROPOSITION had written or printed on their ballots the words, "FOR THE ISSUANCE OF THE COURTHOUSE YARD BONDS AND THE LEVY OF THE TAX ", and those opposing the said THIRD PROPOSITION had written or printed on their ballots the words, "AGAINST THE ISSUANCE OF THE COURTHOUSE YARD BONDS AND THE LEVY OF THE TAX", - the manner of holding said election being governed by the Laws and Constitution of the State of Texas relating to elections, and a copy of the ordinance adopted by said Council on the 1st day of July, 1947, signed by the Mayor of the City of Huntsville, Texas and attested by the City Secretary, with the seal of the City affixed thereto, was ordained to be a proper notice of said election, and it was ordered and directed that notice of said election should be given by posting a substantial copy of the election order in each of the wards of said City of Huntsville, Texas and also at the City Hall and Fire Station within said City, as well as by publishing a copy thereof on the same day in each of two (2) successive weeks in the newspaper of general circulation published within said City, the date of the first publi- cetion to be not less than fourteen (14) days prior to the date set for said election; and, - 2 - WHEREAS, said notice of election was given in the manner and for the length of time required by law and the ordinance afore - said, and said election was duly held on the 29th day of July, 1947; and, WHEREAS, the returns of said election were duly certified by the Manager and Judge and clerks and said returns were duly and legally canvassed by the City Council and at sFid election there were cast 153 votes, and the number of votes cast for each propo- sition were, namely: FIRST PROPOSITION: "For the issuance of the airport bonds and the levy of the tax" 117 votes, "Against the issuance of the airport bonds and the levy of the tax" 33 votes, majority "For issuance of bonds" 84 votes; SECOND PROPOSITION: "For the issuance of the street improvement bonds and the levy of the tax" 116 votes, "Against the issuance of the street improve- ment bonds and the levy of the tax" 34 votes, majority "For issu- ance of bonds" 82 votes; THIRD PROPOSITION: "For the issuance of the courthouse ysrd bonds and the levy of the tax" 74 votes, "Against the issuance of the courthouse yard bonds and the levy of the tax" 74 votes, no majority: THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, IN COUNCIL ASSEMBLED: That said election was duly held on the 29th day of July, 1947 after a valid ordinance providing for said election was made and notice of such election was given in the manner and for the length of time required by law, that at said election only quali- fied electors who owned taxable property in the City and who had duly rendered the same for taxation were permitted to vote, and that said election was had and conducted in accordance with said ordinance, the Laws and the Constitution of the State of Texas, and that at said election there were cast 153 votes, and the number of votes cast for each proposition were, namely: FIRST PROPOSITION: "FOR THE ISSUANCE OF THE AIRPORT BONDS AND THE LEVY OF THE TAX" 117 votes "AGAINST THE ISSUANCE OF THE AIRPORT BONDS AND THE LEVY OF THE TAX" 33 votes MAJORITY "FOR ISSUANCE OF BONDS" 84 votes SECOND PROPOSITION: "FOR THE ISSUANCE OF THE STREET IM- PROVEMENT BONDS AND THE LEVY OF THE TAX" 116 votes "AGAINST THE ISSUANCE OF THE STREET IMPROVEMENT BONDS AND THE LEVY OF THE TAX" 34 votes MAJORITY "FOR ISSUANCE OF BONDS" 82 votes THIRD PROPOSITION: "FOR THE ISSUANCE OF THE COURTHOUSE YARD BONDS AND THE LEVY OF THE TAX" 74 votes -3- "AGAINST THE ISSUANCE OF THE COURTHOUSE YARD BONDS AND THE LEVY OF THE TAX" 74 votes NO MAJORITY IT IS THEREFORE ORDERED AND ORDAINED that the FIRST PROPO- SITION and the SECOND PROPOSITION were carried and that the City Council of the City of Huntsville, Texas is by virtue of the afore- said election duly authorized to issue the bonds provided for in said FIRST PROPOSITION and in said SECOND PROPOSITION and to levy the tax, to pay the interest accruing thereon and to create a sink- ing fund to redeem said bonds at maturity. IT IS FURTHER ORDERED AND ORDAINED that the THIRD PROPO- SITION was not carried and that the City Council of the City of Huntsville, Texas is by virtue of the aforesaid election not author- ized to issue the bonds provided for in said THIRD PROPOSITION nor to levy tax therefor. IT IS FURTHER ORDERED AND ORDAINED that this ordinance shall take effect and be in full force from and after its adop- tion by the City Council and its approval by the Mayor of the City of Huntsville, Texas. The foregoing ordinance was referred to the Committee on Ordinances, in open council, this the 5th day of August, 1947. /s/ Vailbourn S.
