PROHIBITING THE OPERATION OF A TAXI OR TAXICAB WITHIN THE CITY OF
HUNTSVILLE, TEXAS WITHOUT FIRST PROCURING A LICENSE, PERMIT OR FRANCHISE
FROM THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, DEFINING A "TAXI"
OR "TAXICAB" AND PROVIDING FOR A PENALTY FOR THE VIOLATION THEREOF.
BE IT ORDA NED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS:
SECTION 1: As used in this ordinance, the word "taxi"
or "taxicab" shall mean, cover and embrace any vehicle for hire for the
purpose of transporting passengers upon or over the streets, avenues,
alleys, lanes or public ways of the city of Huntsville, Texas, whether
operated wholly within the City or between points outside of the City
and points within the City, except bus lines operating through the City
having a permit from the Railroad Commission of the State of Texas,
and buses hauling or carrying school children on regular scheduled routes.
SECTION 2: No person, firm, association, corporation or
partnership shall hereafter operate a taxi or taxicab within the
corporate limits of the City of Huntsville, Texas without first having
obtained and procured from the City Council of the City of Huntsville,
Texas, a license, permit or franchise permitting and authorizing the
operation thereof.
SECTION 3: Any person, firm, association, corporation or
partnership failing or refusing to comply with any of the provisions of
this ordinance shall be guilty of a misdemeanor, and upon conviction
therefor shall be punished by a fine not exceeding One Hundred (0100.00)
Dollars.
This ordinance shall take effect from and after its adoption
by the City Council, its approval by the Mayor of the City of Hunts-
ville, Texas, and its publication as required by law.
The above and foregoing ordinance was adopted by unanimous
vote of the Council and approved by the Mayor in open council, this the
6th day of September, 1949.
