AN ORDINANCE AMENDING CHAPTER 12, MOTOR VEHICLES AND
TRAFFIC ORDINANCE OF THE CODE OF ORDINANCES OF THE CITY
OF HUNTSVILLE, TEXAS; BY AMENDING SUBSECTION (c), SECTION
12 -56, DIVISION 2, ARTICLE 3, BY DESIGNATING AN EXCEPTION
TO SAID SUBSECTION BY REFERENCE TO A NEW ADDED SUBSECTION:
BY ADDING A NEW SUBSECTION (e) TO SECTION 12 -56, DIVISION
2, ARTICLE 3 OF CHAPTER 12 PROVIDING THAT CERTAIN DESIG-
NATED VEHICLES SHOULD BE EXEMPTED FROM ANY PARKING METER
FEES AND /OR FINES..
(c) Except as hereinafter provided in subsection (e), it
shall be unlawful for any person to cause, allow, let, permit or
suffer any vehicle registered in his name or owned or operated by
him or in his possession or under his control, to be or remain in
any parking space along side of or next to which any parking meter
is placed while the meter is displaying a signal showing that such
vehicle shall have already been parked beyond the period of time
fixed for which payment has been made by deposit of a coin or coins
in the parking meter, without paying, within twenty -four (24) hours
a charge of fifty cents ($0.50) for each hour or fractional part
thereof any such vehicle shall remain parked overtime to the city.
The display of a sign showing illegal parking by any parking meter
while a vehicle is parked in a parking space adjacent or adjoining
such meter shall be prima facie evidence that the vehicle has been
parked overtime and beyond the period of parking fixed for which
payment has been made by deposit of a coin or coins in the meter.
Any person, firm or corporation who fails to pay the parking fees
as provided herein within the time specified, shall, upon conviction
be guilty of a misdemeanor and shall be fined not less than two
dollars and fifty cents ($2.50)nor more than two hundred dollars
($200.00) for each such conviction.
(e) The provisions of this section shall not apply to the
following designated vehicles or to the vehicles owned by, driven
by, or in the possession of the following designated individuals
who are performing or involved in the performance of County, State,
or Government official business:
1. The Texas Ranger Units
2. The Game Warden Units
3. All Department of Public Safety Units (exempt tags) _
4. All Sheriffs Units (exempt tags)
5. Any Justice of the Peace of Walker County
6. Any City of Huntsville Police Vehicle (and emergency vehicles)
exempt tags.
7. Any State and Federal vehicles (exempt tags)
8. Alcoholic and beverage commission representatives
9. Vehicles of the United States Postal Service
It is further ordained that the within Ordinance Amendment
and addition shall become effective immediately upon passage.
