AN ORDINANCE AMENDING CHAPTER 3 A OF THE CODE OF ORDINANCES
OF THE CITY OF HUNTSVILLE, TEXAS, BY ADDING A NEW SECTION
TO BE NUMBERED SECTION 3 -A -3, PROHIBITING THE POSSESSION OR
CONSUMPTION OF AN ALCOHOLIC BEVERAGE ON ANY REAL ESTATE
MAINTAINED OR OPERATED BY THE CITY OF HUNTSVILLE, TEXAS,
AS A PARK OR RECREATIONAL AREA, PROVIDING A PENALTY FOR
VIOLATION OF SUCH ORDINANCE, AND CONTAINING OTHER PROVISIONS
AS THEREIN SET FORTH.
WHEREAS, The City Council of the City of Huntsville, Texas,
has determined and here finds, that possession or consumption of
alcoholic beverages within City Parks and Recreational Areas is not
compatible to the use for which such premises are dedicated and has
resulted in damage to City properties and that preservation of
public property and promotion of the general welfare of the public
requires that the possession or consumption of any alcoholic beverage
on any lands or premises owned or operated by the City of Huntsville,
Texas, as a Park or Recreation Area be prohibited and that the public
interest would best be served by an Ordinance to such effect.
THEREFORE, BE IT ORDAINED by the City Council of the City of
Huntsville, Texas, that Chapter 3 A of the Code of Ordinances of the
City of Huntsville, Texas, is hereby amended by adding a new Section
to be numbered Section 3 A -3, which such Section shall read as follows:
Section 3 A -3. Possession or consumption of all alcoholic
beverages prohibited in Parks and Recreation Areas.
(a) No person, firm, corporation, or other business entity,
shall hereafter possess or consume any alcoholic beverage in or upon
any lands or premises owned or operated by the City of Huntsville,
Texas, as a Park or Recreational area.
(b) Any violation of the provisions of this Ordinance shall
be deemed to be a Class C misdemeanor and shall be punishable as
provided in Section 1 -8 of the Code of Ordinances of the City of
Huntsville, Texas.
