ORDINANCE CREATING THE COMMISSION, OUTLINING
ITS DUTY, AND ORDINANCE

ARTICLE III. PLANNING AND ZONING COMMISSION
Section 2 -36. Definition.
As used in this article, the word "commission" means the planning
and zoning commission created by section 2 -37. (Ord. of 3 -8 -60, § 1)
Section 2 -37. Created; subject to jurisdiction of council; composition.
There is hereby created and established within the city a planning
and zoning commission, which shall be subject to the jurisdiction of the
city council and which shall be composed of nine (9) members, whose offices
are hereby created and established. (Ord. of 3 -8 -60, § 1)
Section 2 -38. Qualifications of members.
The members of the commission shall be citizens of the city residing
within the corporate limits thereof, owners of real estate within the city
and taxpayers and qualified voters of the city. (Ord. of 3 -8 -60, § 1)
Section 2-39. Appointment of members; vacancies.
The members of the commission shall be appointed by the mayor with the
advice and approval of the city council. Vacancies on the commission shall
be filled in the same manner. (Ord. of 3 -8 -60, § 1)
Section 2 -40. Terms of members
The terms of office for members of the commission shall be six (6)
years. (Ord. of 3 -8 -60, § 1)
Section 2 -41. Officers.
The members of the commission shall elect a chairman, vice chairman
and such other officers as they deem necessary, which officers shall serve
for such terms as the commission may designate.

Section 2 -43. Quorum.
A majority of the members of the commission shall constitute a
quorum for the transaction of business. (Ord. of 3 -8 -60, § 5).

Section 2 -44. Designation of time and place of meetings.
The Commission may establish a regular date for meetings, or will
meet on an unscheduled basis as needed or determined by the Mayor and
City Council, the City Manager, or Chairman of the Commission. (Ord. of 6- 14 -77)
Section 2 -45. Powers and duties generally.
The commission shall have the power and authority and it shall be
its duty:
(1) To make studies and project plans for the improvement of the
city, with a view to its development and extension, and to
recommend to the city council all matters for the development
and advancement of the city facilities, layouts and appearance,
and to perform the duties imposed upon the commission by the
statutes of the State of Texas, and specifically by article
974a, Vernon's Annotated Revised Civil Statutes of Texas.
(2) To make plans and maps of the whole or any portion of the city,
and of land outside the city limits located within five (5)
miles of such city limits, and other land outside the city which,
in the opinion of the commission, bears a relation to the planning
of the city, and to make such changes in additions and extensions
of plans or maps within the city as it deems advisable.
(3)
To confer with and advise private property owners pertaining to
location and erection of private structures with the view of
having the same conform with the overall city plan and to advise
with the building inspector in the performance of his duties.

(5) To assist and advise all other municipal and governmental agencies,
including the city council, in formulating and executing proper
plans for municipal development.
(6) To plan and recommend the location, plan and extent of city
alleyways, parks, playgrounds, airports, automobile parking
places, and other public grounds and improvements, for the
location and planning of the public buildings, schools, and other
properties, and of public utilities, including bus terminals,
railroad depots and terminals, whether public or privately owned,
for water, lights, sanitation, sewage disposal, drainage, flood
control, transportation, communication, and shipping facilities,
and for the removal, relocation, widening, extension, narrowing,
vacation, abandonment or change of use of any of the foregoing
public places, works, buildings, facilities, and utilities.
(7) To select and recommend to the city council routes of streets and
avenues, and particularly to investigate and recommend the opening,
widening or abandonment of streets, avenues and alleyways, or the
changing thereof to conform to the city's system, present and
future, all streets, avenues, alleyways and parks.
(8) To investigate, consider and report to the city council upon the
layout and plan of any new subdivision to the city or property
situated within five (5) miles of the city limits and to approve
all plans, plats or replats of additions within the city limits or
within five (5) miles of the city limits.

To recommend to the city council for adoption rules and regulations
governing plats and subdivisions of land within the corporate limits
of the city and within five (5) miles of the corporate limits of the
city, and to promote health, safety, morals, and general welfare of
the community and the safe, orderly and healthful development of the
community. Such rules and regulations may be adopted by the city
council only after public hearing held thereon.
(10) To recommend plans to the city council for improving, developing,
expanding and beautifying parks, lakes, and public buildings in
or adjacent to the city and to cooperate with the city council and
other agencies of the city in devising, establishing, locating,
improving, selecting, expanding and maintaining the public parks,
playgrounds and lakes for public recreation.
(11) To aid and assist the city council by recommending plans for the
development of civic centers and to make investigations and consider
and make recommendations to the council concerning traffic regulations,
routing and control, and highway designations.
(12) To make and recommend for adoption a master plan, as a whole or in
parts, for the future development and redevelopment of the city
and its environs and to prepare a comprehensive plan and ordinance
for zoning the city in accordance with Chapter 283, Acts of the
Regular Session of the Legislature, 1927, and to perform such
other duties as may be prescribed by ordinance or state law. (Ord.

Section 2 -46. Employees and consultants.
The commission shall recommend to the city council the appointment of such
individuals as may, in the opinion of the commission, be necessary for the
proper conduct, operation and undertaking of the commission, including, from
time to time, an engineer or city planning consultant of recognized standing
in the field of city planning and zoning. Such engineer or planning consultant
shall perform the duties prescribed by the commission and be approved by the
city council and shall receive such compensation as may be affixed by the

Section 2 -47. Duty of city officials to cooperate with commission, attend
meetings, etc.
Any requests by the Commission for staff assistance from the City
Administration, shall be forwarded to the City Manager for his review,
coordination and assignment to the appropriate department for action.

Section 2 -48. Rules, regulations and bylaws.
The commission shall, subject to the approval of the city council, make
such rules and regulations and adopt such bylaws for its own government as it
