ORD CC 09/12/72 - No work without permitAN ORDINANCE AMENDING SUBPARAGRAPH (a), SECTION 106.1 OF THE
BUILDING CODE OF THE CITY OF HUNTSVILLE, TEXAS, BY ADDING ADDI-
TIONAL SENTENCES PROHIBITING COMMENCEMENT OF WORK ON ANY PROJECT
FOR WHICH A BUILDING PERMIT IS REQUIRED UNTIL SUCH TIME AS SAID
BUILDING PERMIT HAS BEEN ISSUED, PROVIDING A METHOD FOR ENFORCING
SUCH PROVISION, AND PROVIDING FOR AN EFFECTIVE DATE.
SECTION I:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
HUNTSVILLE, TEXAS, THAT SUBPARAGRAPH (a), SECTION 106.1 OF THE
BUILDING CODE OF THE CITY OF HUNTSVILLE, TEXAS, BE AMENDED BY
ADDING SENTENCES TO PROVIDE THAT NO PROJECT FOR WHICH A BUILDING
PERMIT IS REQUIRED SHALL BE COMMENCED UNTIL SUCH BUILDING PERMIT
HAS BEEN ISSUED AND PROVIDING THAT THE CITY OF HUNTSVILLE, TEXAS,
MAY ENFORCE SUCH PROVISIONS BY AN ACTION IN A COURT OF APPROPRIATE
JURISDICTION, WITH THE SENTENCES AMENDING SAID SUBPARAGRAPH TO READ
AS FOLLOWS:
A. "Section 106.1 - Action on Applications
(a) - - -. No person, firm or corporation shall
commence work on any project for which a building
permit is required under the provisions of Section
105.1 of this Code until such time as a building
permit has been issued by the Building Official.
The City of Huntsville may enjoin or restrain in
a Court of competent jurisdiction any construction
or work, or continuing construction or work, on
any such project commenced prior to the issuance
of such building permit."
B. Section 106.1, Subparagraph (a), of said Building
Code remains unchanged other than the additional
sentences added by the within ordinance.
SECTION II:
BE IT FURTHER ORDAINED BY THE CITY COUNCIL OF THE CITY
OF HUNTSVILLE, TEXAS, THAT THIS ORDINANCE AMENDING SUBPARAGRAPH
(a) OF SECTION 106.1 OF THE BUILDING CODE OF THE CITY OF HUNTSVILLE,
TEXAS, BE EFFECTIVE FROM AND AFTER THE PASSING OF THIS ORDINANCE.
