OF THE CITY OF HUNTSVILLE, TEXAS, BY AMENDING
AN ORDINANCE HERETOFORE PASSED KNOWN AS THE
HEALTH ORDINANCE OF THE CITY OF HUNTSVILLE,
TEXAS, BY ADDING THERETO NEW SECTIONS TO BE
NUMBERED ARTICLE IV, SECTION 1, PART B, SECTION
XXVI A, IMPOSING A PENALTY FOR VIOLATION OF
SAID ORDINANCE; AND ARTICLE V, PROVIDING FOR
DEFINITIONS; FENCING OF SWIMMING POOL; PURIFICATION
OF WATERS; INSPECTION BY HEALTH OFFICER OF THE
CITY OF HUNTSVILLE; AND IMPOSING A PENALTY FOR
VIOLATION OF SAID ORDINANCE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTS -
VILLE, TEXAS, THAT THE CODE OF ORDINANCES OF THE CITY OF HUNTSVILLE
BE AMENDED BY AMENDING AN ORDINANCE HERETOFORE PASSED ENTITLED
HEALTH ORDINANCE OF THE CITY OF HUNTSVILLE, TEXAS, BY ADDING THERETO
NEW SECTIONS TO BE NUMBERED ARTICLE IV, SECTION 1, PART B, SECTION
XXVI A, PENALTY; ARTICLE V, SWIMMING POOL REGULATIONS, WHICH SAID
NEW ARTICLES SHALL READ AS FOLLOWS:
ARTICLE IV, Section 1, Part B, Section XXVI A.
Any person who shall violate any provision of this
Ordinance shall upon conviction be fined in an amount
not less than $5.00 nor more than $200.00, and each
and every day that such violation continues shall con-
stitute a separate and distinct offense.
ARTICLE V, Swimming Pool Regulations.
Section 1. Definitions.
a. Swimming pool is hereby defined as a receptacle for
water, or an artificial pool of water having a depth at
any point of more than 18 inches, intended for the pur-
pose of immersion or partial immersion therein of human
beings, and including all appurtenant equipment, con -
structed, installed, and maintained in or above the ground
and used collectively by numbers of persons for swimming
and recreational bathing.
b. Private residential swimming pool is hereby defined
as a receptacle for water, or an artificial pool of water
hav ing a depth at any point of more than 18 inches, in-
tended for the purpose of immersion or partial immersion
therein of human beings, and including all appurtenant
equipment, constructed, installed, and maintained, in or
above the ground and used for a single family dwelling
unit.
Section 2. Swimming Pools
a. Compliance Hereafter no person shall construct or

maintain a swimming pool without complying with the
terms and provisions of this ordinance as hereinafter
set out. Any person owning or maintaining an existing
swimming pool is given sixty (60) days within which
to comply with the terms of this ordinance.
b. Fence. No person is to construct or maintain any
swimming pool without the erection of a fence not less
than four (4) feet nor more than ten (10) feet, and so
constructed as entirely to enclose the area on which
the swimming pool is located and to bar all reasonable
and normal access to the swimming pool except through
a substantial self-closing gate or gates the same heights
as the fence, with facilities for locking the gate. Gates
shall be kept locked when the swimming pool is not in use.
c. Sanitary Conditions.
(1) Any person owning or maintaining any swimming pool
shall maintain such pool in a sanitary condition. The
bacterial content of the water in any swimming pool shall
not be allowed to exceed the safe limits as prescribed by
established standards of the State Department of Health.
Residual chlorine from 0.2 to 0.5 parts per million units
of water or any other method of disinfectant approved by
the State Department of Health shall be maintained in
every swimming pool throughout the period of their use.
(2) No water in any swimming pool shall ever be permitted
to show an acid reaction to a standard pH test.
d. Inspection. At least once every 1 months the Health
Officer or his authorized representative shall inspect
every swimming pool located within the City and make an
inspection report. In the event the Health Officer or
his representative discovers a violation of the terms and
provisions hereof, he shall notify the person owning or
maintaining such pool of the violation by leaving a copy
of an inspection report with the person owning or main-
taining such pool. The Health Officer shall make a second
inspection after a lapse of not less than 10 days there-
after, and if the reported violation shall not have been
remedied such person owning or maintaining said pool shall
be subject to the penalties imposed under this act.
Section 3. Private Residential Swimming Pools.
a. Fence. No person is to construct or maintain any
private residential swimming pool without the erection
of a fence not less than four (4) feet nor more than ten
(10) feet, and so constructed as entirely to enclose the
area on which the private residential swimming pool is
located and to bar all reasonable and normal access to
the private residential swimming pool except through a

b. Compliance. Hereafter no person shall construct or
maintain a private residential swimming pool without
complying with the terms and provisions of this ordinance
as herein set out. Any person owning or maintaining an
existing pool is given sixty (60) days within which to
comply with the terms of this ordinance.
Section 4. Penalty. Any person who shall violate any provision of
this ordinance shall upon conviction be fined in an amount
not less than $5.00, nor more than $200.00, and each and
every day that such violation continues shall constitute
a separate and distinct offense.
