Minutes - 11/01/2016 ST MINUTES FROM THE HUNTSVILLE CITY COUNCIL REGULAR MEETING HELD ON THE 1 DAY OF NOVEMBER 2016, IN THE CITY HALL, LOCATED AT 1212 AVENUE M, IN THE CITY OF HUNTSVILLE, COUNTY OF WALKER, TEXAS, AT 6:00 P.M. The Council met in a regular session with the following: COUNCILMEMBERS PRESENT: Andy Brauninger, Paul Davidhizar, Lydia Montgomery, Don H. Johnson, Keith D. Olson, Joe Emmett, Tish Humphrey, Ronald Allen, Joe P. Rodriquez COUNCILMEMBERS ABSENT: None OFFICERS PRESENT: Matt Benoit, City Manager; Leonard Schneider, City Attorney; Lee Woodward, City Secretary MAIN SESSION \[6:00 p.m.\] 1. CALL TO ORDER – Mayor Brauninger called the meeting to order at 6:00 p.m. 2. INVOCATION AND PLEDGES U.S. Flag Texas Flag: Honor the Texas Flag. I pledge allegiance to thee, Texas, one state, under God, one, and indivisible. Councilmember Rodriquez gave an invocation and Cooper Hooks from HISD led the pledges. 3. PRESENTATIONS AND PROCLAMATIONS - Message from Heart Walk Committee and Mayor Brauninger 4. CONSENT AGENDA Public Comments will be called for by the presiding officer before action is taken on these items. (Approval of Consent Agenda authorizes the City Manager to implement each item in accordance with staff recommendations. An item may be removed from the Consent Agenda and added to the Statutory Agenda for full discussion by request of a member of Council.) a. Approve the minutes of the City Council meeting held on October 18, 2016. \[Lee Woodward, City Secretary\] b. Approve tax sale bid for trust properties with Property IDs 25976, 26306, 25836, 38292, 26421, 25612, 25832, 26352, 26270, 25914, and 26501, as recommended by the Walker County Appraisal District. \[Steve Ritter, Finance Director\] Councilmember Montgomery moved to adopt the consent agenda; the motion was seconded by Mayor Pro Tem Olson. The motion was unanimously adopted, 9-0. 5. STATUTORY AGENDA a. Presentation, public comment, discussion, and possible action to authorize the City Manager to sign Addendum D, for a Guaranteed Maximum Price in the amount of $355,800 to the Construction Manager at Risk Agreement with Anchor Construction for the City of Huntsville Transfer Station, second reading. \[Carol Reed, Director of Public Works\] Councilmember Johnson moved to authorize the City Manager to sign Addendum D, for a Guaranteed Maximum Price in the amount of $355,800 to the Construction Manager at Risk Agreement with Anchor Construction for the City of Huntsville Transfer Station to complete underground utilities and final grading; the motion was seconded by Councilmember Davidhizar. The motion was adopted, 8-1, Councilmember Allen voting against. 6. MAYOR/CITY COUNCIL/CITY MANAGER AND CITY ATTORNEY REPORT a. Presentation, public comment, discussion, and possible action to approve Mayor’s nominations for City boards and commissions. \[Mayor Brauninger\] Mayor Brauninger moved his nominations. The following re-appointments were approved by the Council, 9-0. Main Street Program Advisory Board TIRZ #1 Board of Directors Gaye Clements – re-appointment Barry Shoemake – re-appointment Don H. Johnson – re-appointment 7. REQUESTS FOR CITIZEN PARTICIPATION An opportunity for citizens to be heard on any topic and for the City Council to participate in the discussion. No action will be taken. No requests were received by noon on Tuesday, October 25, 2016. 8. MEDIA INQUIRIES RELATED TO MATTERS ON THE AGENDA There were no media inquiries. 9. ITEMS OF COMMUNITY INTEREST (Hear announcements concerning items of community interest from the Mayor, Councilmembers, and City staff for which no action will be discussed or taken.) Mayor Brauninger announced: - Mayor Pro Tem Olson has an HISD minute, congratulating the HHS Military Marching Band for their receiving all 1s for the twelfth year in a row at the recent UIL competition. - We want all citizens to be fully informed on the upcoming bond election. Visit www.huntsvilletx.gov/Bond to watch the video and learn more. - Early voting continues through Friday and election day is one week from today. Please check our website for details on locations and times. Post a photo of yourself to our social media using #ShowUsYourSticker! - REMEMBER TO VOTE THE BACK SIDE OF YOUR BALLOT! City elections are on the back of the ballot! - The downtown Farmers Market has begun again for the fall, every Saturday from 8-noon through November 19. - On Nov. 5 at 10 am, there will be a marker placement at Oakwood, commemorating the local victims of the Yellow Fever epidemic. Councilmember Humphrey reminded all of SHSU’s Pink-Out game on Saturday, November 5 and that the team is still in first place. She also announced Curves raised $190 for their Heart Walk team last night, charging for Halloween parking. Councilmember Humphrey finished by asking people to contact her if they were interested in helping with youth in relation to youth court. Mayor Brauninger shared how much he enjoyed his experience judging the children’s costume contest at Scare on the Square Saturday and accepting the game ball from the skydiver at last Saturday’s SHSU game. He also reminded everyone of the Good Shepherd Mission lunchtime fundraiser on Monday, November 7 at City Hall Café. 10. EXECUTIVE SESSION a. City Council will convene in closed session as authorized by Texas Government Code Chapter 551, Section 551.074 - personnel matters regarding the evaluation and job duties of City Manager Matt Benoit. The Council adjourned into Executive Session at 6:20 p.m. 11. RECONVENE Take action, if necessary, on items addressed during Executive Session. The Council reconvened at 7:06 p.m. Mayor Pro Tem Olson moved to strike Article 12 from the City Manager’s contract, add a 2.5% pay increase, and accept the remainder of the contract. The motion was seconded by Councilmembers Humphrey and Johnson. The motion was adopted, 8-1, Councilmember Allen voting against. 12. ADJOURNMENT Mayor Brauninger adjourned the meeting at 7:10 p.m. Lee Woodward, City Secretary
