ORD 2011-58 - Youth Advisory Board Modifies Secs 1 And 2 [10-04-2011]ORDINANCE NO. 2011-58 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, AMENDING ORDINANCE NO. 2004-02, WHICH MODIFIED THE YOUTH ADVISORY BOARD, BY REPLACING SECTIONS 1 AND 2 WITH NEW SECTIONS 1 AND Z AM MAKING OTHER FINDINGS AND PROVISIONS RELATED THERETO; AND PROVIDING FOR AN EFFECTIVE DATE HEREOF. WHEREAS, the City Council previously adopted Ordinance No. 2003-04 creating a Youth Advisory Board ("Board") to enhance youth relations and make Huntsville truly a community where youth are valued, and Ordinance 2004-02 amending the membership of the Board; WHEREAS, the City Council finds that the number of members required to promote efficiency of Board actions and this purpose can be accomplished by replacing Sections 1 and 2 of Ordinance 2004-02 with new Sections 1 and 2; and WHEREAS, notice of the agenda for this meeting, was given in accordance with law by posting the same at the place reserved and designated for notices of public meetings and public activities and prior to the adoption of this ordinance. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, that: SECTION 1: The facts and matters set forth in the preamble of this Ordinance are found to be true and correct and are hereby adopted, ratified, and confirmed. SECTION 2: Ordinance No. 2004-02 is amended by replacing Sections 1 and 2 with new Sections 1 and 2 as provided below: SECTION 1: Section 1 of Ordinance 2004-02 is hereby amended to read: There shall be a Youth Advisory Board consisting of twenty members; members shall be appointed by the Mayor with approval of Council; members shall be representative of the entire community. SECTION 2: Section 2 of Ordinance 2004-02 is hereby amended to read: The members of the Board shall be identified by place numbers one (1) through twenty (20). Places one (1) through three (3) shall be appointed for terms of three years each; places four (4) through ten (10) shall be appointed for terms of two years each; places eleven (11) through twenty (20) shall be reserved for youth members, and their terms shall be for one year each. SECTION 3: All ordinances or parts of ordinances that are in conflict or inconsistent with the provisions of this Ordinance shall be, and the same are hereby, repealed, and all other ordinances of the City not in conflict with the provisions of this Ordinance shall remain in full force and effect. SECTION 4: Should any paragraph, sentence, clause, phrase or section of this Ordinance be adjudged or held to be unconstitutional, illegal or invalid, the same shall not affect the validity of this Ordinance as a whole or any part or provision thereof, other than the part so declared to be invalid, illegal or unconstitutional. SECTION 5. The City Council finds that notice was posted and the ordinance was passed in accordance with the Open Meetings Act. SECTION 6: This Ordinance shall take effect immediately from and after the date of its passage in accordance with Article 4.15 of the City Charter.
