ORDINANCE 2012-25 AN ORDINANCE AMENDING CHAPTER 12, TITLE 24 LAND DEVELOPMENT OF THE HUNTSVILLE, TEXAS MUNICIPAL CODE TO CHANGE LANDSCAPING REQUIREMENTS WHEREAS, the City of Huntsville is a home rule city acting under its charter adopted by the electorate pursuant to the Texas Constitution and the Local Government Code; and WHEREAS, the Planning and Zoning Commission of the City of Huntsville at their meeting on April 5, 2012 held a public hearing prior to consideration of amending the ordinance; WHEREAS, the City Council held a public hearing at their meeting on May 01, 2012 and May 15, 2012 prior to consideration of amending the ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, COUNTY OF WALKER, STATE OF TEXAS: I. FINDINGS OF FACT All of the above premises are hereby found to be true and correct legislative and factual findings of the City of Huntsville, Texas, and are hereby approved and incorporated into the body of this ordinance as if copied in their entirety. II. AMENDMENT Huntsville Development Code, Chapter 12,Landscaping,Bufferyard, Park and Other Open Space Standards; Title 24,Land Development, of the Huntsville,Texas Municipal Code shall be amended as follows: 1201.4 Landscape maintenance and Planting Area (1) Each canopy tree planted under Section 1201.2(b) shall be in a planting area sufficient for growth,maintenance, and irrigation. III. REPEALER All ordinances or parts of ordinances in force when the provisions of this Ordinance becomes effective which are inconsistent or in conflict with the terms and provisions contained in this Ordinance are hereby repealed only to the extent of any such conflict. IV. SEVERABILITY It is hereby declared to be the intention of the City Council that the phrases, clauses, sentences, paragraphs and sections of this ordinance be severable, and if any phrase, clause, sentence, paragraph or section of this Ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences or sections of this ordinance, and the remainder of this Ordinance shall be enforced as written. V. EFFECTIVE DATE .............................. . This Ordinance shall take effect ten (10) days after its passage by the City Council. The City Secretary shall publish the caption of this ordinance in the official City newspaper at least twice within ten (10) days of its passage. VI. PROPER NOTICE AND MEETING It is hereby officially found and determined that the meeting at which this Ordinance was passed was open to the public and that public notice of the time, place and purpose of said meeting was given as required by the Open Meetings Act, Chapter 551 of the Texas Government Code. Background: Chapter 12 of the Development Code requires landscaping for commercial development within Huntsville. As part of the requirement of tree distribution within parking areas, the Code states that "each canopy tree planted under section 1201.2(b) shall be in a planting area whose radius is not less than 6' measured from the tree trunk to the near edge of the landscaped area". Typical parking spaces are 9' in width and are commonly used as planting areas for trees within the parking lot. The trees that have been planted in these areas, while not in strict compliance with the Code, meet the intent of the code and have survived. The 6' radius planting area, if strictly and literally enforced, would hamper efforts to increase the number of trees in parking areas and is not necessary due to the presence of irrigation in most of these planting areas. The proposed change to the Development Code would not reduce the number of trees required nor would it remove the fact that a property owner would be required to replace a tree should it die. Additional information as requested by the Council during the first reading of the ordinance will be presented at the meeting. Facts to Consider: • 6' minimum radius landscaping areas are more than is needed to maintain healthy trees in many parking areas. • The proposed change would require that the landscaping areas be large enough to ensure the health and safety of the tree. • The change would provide additional leeway to staff to meet the intent of the code to provide landscaping and shade areas within parking lots. • The Planning and Zoning Commission unanimously voted to recommend approval of the changes to the Development Code as presented. (2) All canopy tree plantings shall be encompassed with an approved curb barrier to prevent access by vehicular traffic. (3) Every development shall employ either an irrigation or sprinkler system or have a hose connection within one hundred fifty(150) feet of all landscaping. (4) The Developer shall maintain and protect landscaped areas and shall replace all dead landscaping within forty-five (45) days after notification by the Building Official. The Building Official may, however, extend the replacement period based upon seasonal consideration. Replacement plantings shall be equal to the types of plantings proposed on the landscape development plan. (5) Section 1201.2 shall not be construed to reduce landscape requirements for site landscaped after August 18, 1981. The area of any site devoted to landscaping and required under Section 1201.2(1) shall not be reduced by any building expansion or development. The Development Code requires part of the tree distribution requirement to be within the parking lot landscaping. The modern design of parking lot islands contradicts the six (6) foot rule found in Section 1201.4(1) because most landscape islands within a parking lot are about nine (9) feet wide or smaller. Removing the six (6) foot rule will entice more trees in the parking areas as customers search for tree shaded parking spaces during the heat of the summer. Staff finds that there is no agricultural reason to keep the six (6) foot rule due to the different types of trees being planted as well as 98% of landscaping now is irrigated; and, the trees that have been planted closer than six (6) feet to the curb are surviving very well. This item will be forward to City Council on May 1st and will require two readings with the last reading being on May 15, 2012 before final adoption of the ordinance (if approved). STAFF RECOMMENDATION: After a public hearing, staff recommends approval of the changes as presented so that it may be forwarded to City Council.
